TERMS AND CONDITIONS

These Terms & Conditions are administered on behalf of Virago Ladies Fitness LLC / trading as Virago Fitness. References to ‘we’, ‘us’ and ‘our’ are references to the Virago Fitness LLC trading as Virago Fitness, registered in the UAE, and whose registered office is at, Ajman, UAE. Virago Fitness LLC maintains the website (http://viragofitness.ae).

References to ‘you’, ‘your’ and ‘yours’, and after acceptance, the member, are references to the individual completing the membership application form/doing payment trough link/online.

You must be between 11 and 15years of age and be under the direct supervision of a parent/guardian or a Virago Fitness Personal Trainer. Children of 16 years of age or above will have normal individual access permitted.If you are under the age of 18, you will not able to register through website – your registration must be done in person at our reception.

COVID-19 PRECAUTIONARY MEASURES

  1. As a member, you will follow all precautionary measures to combat Covid-19.
  2. You must wear your mask at all times. Masks can be lowered while engaged in strenuous physical exercise.
  3. Follow social distancing – please keep at least 2 meters of social distancing.
  4. Use the booking system on the app to book your classes access. You must present this to reception upon arrival to show that you have booked a time
    slot. You will be asked to wait if it is not your time slot or turned away if you have passed your time slot.

PRINCIPLE TERMS

  1. 1. In accepting these Terms & Conditions the member warrants and also represents that she is in good health and is not knowingly incapable of engaging in either active or passive exercise. The member further warrants that such exercise would not be detrimental to their health, safety, comfort, wellbeing or physical condition.
    2. The member shall not use any Virago Fitness facilities whilst suffering from any infections or contagious illness, disease or other ailment such as open cuts, abrasions, open sores or minor infection, where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other members.
    3. Before using a Virago Fitness facility, the member or visitor must read and confirm the agreement/contract of our Member Declaration Form.
    4. If a member is taking medication and is aware of a condition that may affect them taking part in exercise a doctor’s letter would be needed.
    5. Any specific medical issues, shall be communicated to the Personal Trainer all times to avoid injurie or illness.

FEES AND CHARGES 

A. General

1. All published membership or other fees and other charges are inclusive of any taxes (e.g. VAT). The Virago Ladies Fitness LLC TRN number is 100531098000003 and this applies to all charges from Virago Fitness LLC applied under these Terms and Conditions. Your VAT invoice for any monthly memberships or other fees or charges is available for you to collect from the gym reception, trough application and in your personal email (if this one was shared properly at registration time).
2. The fees of any membership in Virago Fitness can be changed anytime without previous warning;
3. The membership shall be paid through online link or directly at reception as per Virago Fitness Regulations, although Virago Fitness reserves the right to have different types or membership prices as per internal management decision.
4. Fees at reception and online might differ as per Virago Fitness Management decision;
5. The payment shall be done in 1 time only. The member can upgrade the membership as per internal regulations of Virago Fitness;
6. All credit/debit cards’ details and personally identifiable information will NOT be stored, sold, shared, rented, or leased to any third parties.
7. Virago Fitness will not pass any debit/credit card details to third parties
8. Virago Fitness takes appropriate steps to ensure data privacy and security including through various hardware and software methodologies. However, (Virago Fitness) cannot guarantee the security of any information that is disclosed online
9. Virago Fitness is not responsible for the privacy policies of websites to which it links. If you provide any information to such third parties different rules regarding the collection and use of your personal information may apply. You should contact these entities directly if you have any questions about their use of the information that they collect.
10. The Website Policies and Terms & Conditions may be changed or updated occasionally to meet the requirements and standards, without previous warning. Therefore, the Customers’ are encouraged to frequently visit these sections to be updated about the changes on the website. Modifications will be effective on the day they are posted.

b. Recurring payment

11. Recurring membership is considered a SILVER membership, with no access to GOLD or above packages.
12. Once a payment card has been replaced by a new one we will charge the new card, however in case your account goes unpaid your membership will be considered canceled.
13. PRICE FOR LIFE* means as long the member doesn’t cancel it will have always the same price.
14. Instalment plan payment fees will be decided as per management decision, and can be adjusted at any time without previous notice, advising the member to up to date all terms and conditions when necessary.
15. The recurring payment is charged always in the same date doesn’t matter the reason of delayed payment.
16. If an error from Virago or bank side happens, since it’s temporary error, the system will schedulea new try to process the payment. The maximum tries are 5. If upon the 5th time the payment is not processed, the membership will be automatically suspended, the member will not be able to use the premises till the payment is settled manually trough Mobile Application ONLY. If this payment is not settled within 30 days from the renewal date, the recurring membership will be automatically CANCELED.
17. If an error from costumer card/bank account happens, it’s a one-time error, will suspend the membership immediately, the payment should be settled by the member trough Mobile Application ONLY. If this payment is not settled within 30 days from the renewal date, the recurring membership will be automatically CANCELED.
18. In case any the errors happen, the member needs to settle the payment within 30 days, noting the amount due will be deducted, as the recurring membership is continues, and is charged always at same date.

PAYMENT METHOD

a. General

1. We accept payment by Visa or MasterCard debit and credit cards in AED for our memberships and other products and services. All online purchases are also governed by the terms and conditions of respective merchant service providers. Please review the respective merchant service provider’s user agreement and privacy
policy before entering any transaction.
2. Payment confirmation via email to the email address you provide at the point of registration will be issued within 24 hours of successful processing of your payment.
3. You, as the cardholder, must retain a copy of transaction records and Merchant policies and rules.
4. You are responsible for maintaining the confidentiality of your membership account and payment details.

b. Recurring payment

5. The recurring membership it is ONLY accepted through ONLINE channel (MOBILE APLICATION)
6. In case the member decided to cancel their membership payment method prior to the completion of a contract, 0 charges or fees will be applied.

CANCELLATION AND REFUNDS

a. General

1. Cancellation of membership is not permitted and is non-refundable. However, “on a case to case” basis, the Management may allow TRANSFERE application due to relocation or medical reasons, provided that proof will be submitted and is subject for approval. To apply for cancellation, members must fill up a specific form, attach relevant documents and submit to management for approval. A cancellation fee of 250aed will be applied once the cancellation is approved. Other expenses might need to be applied and deducted from the refund (POS charge, VAT, etc.). This Membership Agreement is not cancelable by Member except as expressly provided above included, without limitation, by reason of member failure to utilize the facilities of Virago Fitness.

b. Recurring payment

1. The membership can be canceled at any time and moment, as long as the member acknowledges that after cancelation and once returning, the charges will be applied from the 1st installment plan.
2. In order to cancel the Recurring membership, the member shall use the MOBILE APPLICATION.

CANCELLATION WITHIN CONTRACT

a. General

1. Membership is not refundable, or transferable, as per contract, there are situations where you can fill a cancelation form, that will go for approval trough Virago Fitness Management in order to get a special approval:
1.1 Relocation: This agreement can be transferred in the event that your new permanent address is 30km away from any Virago Fitness gym. Any transfer in respect to a member’s relocation is dependent on satisfactory receipt of proof of your relocation and new address (e.g. new tenancy agreement in your name).
1.2 Pregnancy: This agreement can’t be cancelled, but we offer the freezing for the whole duration of pregnancy, plus 40 days after delivery, if you become pregnant upon the appropriate written proof being given, (After
this period to add freezing if your condition still doesn’t allow you to use the gym, a medical report will need to be presented.

2. Please note – ANY Cancellation for the above reasons will not be effected until the appropriate proof is provided to a member of the Virago Fitness team and you receive a written confirmation response from Virago Fitness Management.

b. Recurring payment

3. You may cancel your membership at any desired moment without any fees applied.
4. If the you want to return to the gym trough instalments plan, your instalments will start from the beginning. Without any extra fees, although the price might have changes per Virago Fitness management decision.
5. Cancelation can be done at any time from the member side.

c. Personal Training

6. Personal Training is not transferable and non refundable;
7. Sessions not canceled within 12h, will be charged by the trainer;
8. The Personal Training contract it is not valid if membership is expired or did not renew it.

Freezing

a. General

1. Freezing membership is allowed on remaining terms for upfront payment membership types:
a. 3 months membership: 15 days freezing
b. 6, 12 and instalments membership: 30 days freezing
c. The freezing will be added 1 time only, can’t be spited in more than that
2. The member can add an extra 30 days freezing any time needed, as long the membership is valid for 7 days, with an extra 100aed fee per each extra freezing.
3. The freezing doesn’t allow the member to enter the premises, and if this one wants to unfreeze, this freezing will be counted as done.
4. Please note – ANY Freeze will not be affected until the appropriate proof is provided. Once your freeze has been processed you will not have access to the facilities until the freeze period has come to an end.

b. Recurring payment

5. This membership doesn’t have the option of freezing at any moment, if the members decides to stop using the gym without paying the next instalment, it will be automatically counted as a cancelation. All the cancelation conditions will be applied.

c. Personal Training

6. Personal Training contract runs with the membership contract , if the membership is freezed also will be the personal training package. As also both will unfreeze together.

DATA SECURITY

7. In the course of completing your membership and/or creating the Monthly Recurring Payment, we may collect certain personal information about you including personal details and information about your health and person. We will use this information for purposes including managing your membership and communicating with you. You have the duty to keep your personal information up to date and to inform us of any significant changes.
8. The member shall share email and phone number at all times, in order to access the MOBILE APLICATION and receive email notifications of due payments/membership information and others.
9. We will limit access to the processing of and use of your personal information to our employees and management who may, from time to time, require its use for marketing or other services. In addition, from time to time, we may need to make your personal information available to third parties such as legal authorities, our group companies, and professional advisors.
10. We may also provide your contact information to our business partners and third parties who may contact you about their products and services. Please inform us during the signup process if you do not wish to receive such information.
11. Please contact us if you have any questions or concerns about how we will use and store your personal information or if you wish to exercise your right to access, modify, object to the use of, or request the deletion of your personal information.
12. We will endeavor to use whatever method of communication deemed appropriate to notify you of the Gym information in order to best serve your experience and assume that the information provided by you is correct and an acceptable method to provide you with this information.
13. As a member of the Virago Fitness you acknowledge that you have read and understood the provisions of this paragraph and that you agree that we may collect, use, process and disclose your personal information as described here in above.

HEALTH AND SAFETY

1. All members and visitors who are undertaking in any exercise are required to accept our “Health Form” at the point of registration and before commencing any exercise within the GYM.
2. Members should be considerate of other members by using their own workout towel when using any of the exercise stations.
3. Members are requested to return all portable equipment to the racks provided.
4. Members unsure about any equipment should consult a member of staff.
5. Fitness instructors and Virago Fitness members of staff, are authorized to stop anyone from exercising if in their opinion the member/guest is exercising in a manner that may result in personal injury and/or injury to others. Users must abide by the guidance of Gym instructors.
6. While every precaution is taken to maintain safety standards, all equipment and facilities are used entirely at the member’s or guests’ own risk. Any malfunction of equipment noted should be reported to a member of staff as soon as it is noticed.
7. We reserve the right to close any part of the building or withdraw equipment for conducting essential repairs or maintenance. Prior notice will be given where possible to avoid inconvenience.
8. For safety purposes kindly use plastic bottles with sports lids for drinks where allowed.
9. For safety and hygiene purposes, no eating is allowed inside the gym.
10. Members or guests may not use the facilities whilst under the influence of alcohol, narcotics or other mood-altering substances.
11. Virago Fitness operates a strict no smoking policy.

DRESS CODE

1. All members are required to wear proper gym attire when exercising and to dress modestly when working out. Short workout tops that expose the midriff, torn clothes, jeans, denim shorts, and beanie hats are strictly not permitted.
2. Non-marking, rubber-soled sports shoes/footwear are required at all times in the gymnasium and in the group exercise studios. “Crocs” and “flip-flops” are not considered suitable workout shoes.
3. Members should remain modestly and appropriately dressed at all times, including in the changing areas.
4. Nudity is strictly not permitted and members are requested to use the private changing cubicles provided.

LOCKERS

1. Temporary lockers are provided for the members who shall remove their personal belongings at the completion of their visit. The Gym has the right to cut open any padlocks and remove personal belongings that are left in the lockers at the end of each day.
2. Unclaimed property over the value of AED50 shall be kept by the Gym for a period of 1 week after which the management reserves the right to dispose of the items in such way it in their entire discretion deems fit. Clothing and other similar items will be disposed of after a 1-week period.

BEHAVIOUR

1. Members and guests must treat Virago Fitness facilities and one another with respect; failure to comply shall constitute a serious breach of the terms of membership, and could result in the loss of membership.
2. Threatening, intimidating, or abusive behavior will not be tolerated towards any member of staff or the company. Should such incidents take place a member’s membership will be immediately suspended and all future payments will be collected immediately.
3. We reserve the right to prevent access to, or use of, the facilities by anyone deemed to be acting inappropriately or behaving in an unacceptable manner, as determined by Virago Fitness Management.
4. As a courtesy to other members, Gym equipment should be wiped down by members after use, and all equipment returned to its correct position.
5. Any anti-social or offensive behavior will result in the member or guest being immediately evicted from the gym and your membership cancelled.
6. Virago Fitness Social Media platforms are intended as a means of creating community, facilitating communications, and providing a forum for the expression of feedback. Inflammatory posts, including any content which is judged by our management at its absolute discretion to consider inappropriate, may be subject to remedial action, including removal of the offending posts, blocking access, and termination of membership as a consequence of serious misconduct.
7. Good personal hygiene is mandatory, and any member who causes offense will be asked to remedy the offending problem or leave the gym and membership may be cancelled at Virago Fitness management’s sole discretion.
8. Sharing membership cards is strictly not permitted, any member caught sharing membership cards or providing non-members with unauthorized access to Virago Fitness, will be subject to their membership being cancelled and the remainder of their contract period being billed.
9. Members who are accessing a Virago Fitness location through a complimentary membership –won in a competition, through a Virago Fitness partnership or other promotion, are also subject to these terms and conditions. Virago Fitness management reserve the right to cancel a complimentary membership if the terms and conditions are not being adhered to. Virago Fitness management also reserve the right to refuse access to members accessing the gym on a complimentary membership, in order to abide by any covid regulations currently in place by the UAE government. Members will still be entitled to their complimentary membership but this may have to be used during a non-peak time as per the guidance of Virago Fitness manager or deferred to a later date.

GYM FACILITIES

1. The management accepts NO responsibility for theft or damage to a member’s personal belongings kept in the lockers or otherwise for any reason whatsoever.
2. The use of mobile phones with camera features and/or and other types of visual records in changing rooms is strictly prohibited, and members are requested to ensure that they do not offend any other person when utilizing such equipment within our facility.
3. Members and guests are not allowed to bring their own food or drinking (if not water or sport supplementations) into Virago Fitness.
4. The normal hours of operation are as indicated from time to time at the Gym entrance and notice board. The management reserves the right to adjust the hours for the purpose of cleaning decorating, repairs, and special private functions and holidays.

GENERAL TERMS

 1. Upon successfully becoming a member and on the first visit to Virago Fitness You will be issued with a membership, card (which shall remain the property of the Company) and the member shall be entitled to all the rights and privileges under the class of membership purchased. The loss of a membership card will incur a charge of AED50 per card.
2. Membership cards may only be used by the registered member and any fraudulent use of the membership card by the member, including the use of a membership card by a third party, could result in cancellation of the membership with no refund being made by Virago Fitness.
3. The subscription will be activated from the date requested at the moment of subscription. Maximum period aloud to start membership is 30 days after purchasing. To change a starting date member shall have a valid report (health, traveling, etc), if health report submitted maximum allowed will be 3 months.
4. By visiting the Site, you represent, warrant, and covenant that (a) you are at least 18 years old; (b) The customer using the website who are Minor /under the age of 18 shall not register as a member and shall not transact on or use the website.
5. The member is not entitled to object to the number of participants in the center
6. The member is not entitled to object regarding classes of the center, as classes are offered under each membership.
7. The renewal of membership needs to be done before due date. In case any promotion availed, the member will lose the right to renew with same price if not done before expiration
8. In the event that the Centre is closed for any reason the member will be directed to the nearest available Centre to ensure that the benefits of memberships are continued without interruption. In the absence of an alternative, a period equal to the period in which the center has been closed will be added to the member’s subscription. The member is not entitled to claim extra days if a service or facility is unavailable or under maintenance.
9. Virago Fitness may allow Member to use other Virago Fitness Facilities at its sole discretion. Virago Fitness reserves the right to eliminate locations and facilities available to Member. The hours of operation will be set by Virago Fitness and may change at any time in its sole discretion. Virago Fitness expressly reserves the right to add, eliminate, or alter program, equipment, furniture, or fixture when deemed necessary or desirable at its sole discretion. The information on this agreement is the property of Virago Fitness and its subsidiaries. Membership does not confer on Member any ownership interest in Virago Fitness
or any of its property.
10. Virago Fitness may terminate this agreement with immediate effect with no notice to you if you are in breach of the gym rules or these Terms and Conditions.
11. Soliciting and selling private personal training sessions or merchandise of any type to any member is prohibited and may result in immediate termination of the membership concerned.
12. All members must abide by the Gym rules of the which may be amended and/or added to from time to time at the management’s discretion.
13. Failure by the management to enforce any of their respective rights at any time for any period shall not be construed as a waiver of such rights.
14. Members and/or guests are not allowed to photograph or copy any of our facilities’ interior designs, promotional materials, tag lines, themes, or concepts. We reserve the right to proceed with legal action against any member caught distributing, sharing, or supplying such contents to any third-party vendor or competitor.
15. Virago Fitness will not trade with or provide any services to individuals and companies owned or controlled by or acting for or on behalf of, OFAC targeted countries AND individuals, groups, and entities, such as terrorists and narcotics traffickers designated under the OFAC programs that are not country-specific.
16. Virago Fitness website may automatically produce search results that reference and/or link to thirdparty sites throughout the World Wide Web. We have no control over these sites or the content within them. Virago Fitness does not guarantee, represent or warrant that the content contained in the sites is accurate, legal, and/or inoffensive. Virago Fitness does not endorse the content of any third-party site, nor does it make any representation or warranty about these sites, including that they will not contain viruses or otherwise impact your computer. By using the Site to search for or link to another site, you agree and understand that you may not make any claim against Virago Fitness for any damages or losses, whatsever, resulting from your use of the Site to obtain search results or to link to another site.
